Carriers Insurance

Our Carriers Insurance product is part of our commitment to develop specialised products for our broker partners. This commitment is central to our philosophy and focus on excellence in underwriting and understanding their clients’ businesses and requirements.

Our Carriers Insurance product offers carriers the option of combining their legal liability coverage, and transit damage coverage for goods carried in the normal course of transit, under the one policy.

Our policy is divided into three sections:

  • Section 1 – Legal Liability
  • Section 2 – Accidental Damage
  • Section 3 – Nominated Perils

Each section provides a different type of cover. The carrier selects the section, or sections, they require protection for.

Section 1 – Legal Liability

Our Legal Liability section is designed for carriers who issue consignment notes incorporating conditions of carriage which include a disclaimer against liability for loss of or damage to goods or livestock carried.

Even though a carrier may issue a consignment note and operate under conditions of carriage, legal liability insurance is still necessary.

Circumstances can still arise where courts may set aside disclaimer clauses resulting in the carrier being unable to rely on them to deny liability.  For example: simply failing to obtain a signature on a consignment note before the goods are picked up. This section ensures the carrier’s legal liability is protected if this occurs.

Without this, considerable legal costs may be incurred in defending claims made against the carrier even though conditions of carriage exist and consignment notes are properly issued.

Section 2 – Accidental Damage

and

Section 3 – Nominated Perils

Our Transit Damage Sections, Accidental Damage or, Nominated Perils, are intended for carriers who wish to have the ability to make commercial settlements to their clients should an accident occur.

These sections will also provide protection to carriers who operate without a consignment note, or conditions of carriage, for claims made against them.
